Terms of Service

These Terms of Service ("Terms") govern your use of the Leveling Golf application and website operated by Leveling Golf ("we", "our", "us"). By using our Service, you agree to these Terms.

1. Use of the Service

Leveling Golf provides a golf caddie application that uses sensor data from your Apple Watch to detect swings, identify clubs, track scores, and provide GPS course data. You must be at least 13 years old to use the Service.

2. Account

You may sign in using Sign in with Apple. You are responsible for maintaining the security of your account. You agree to provide accurate information and keep it updated.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse engineer, decompile, or disassemble the app.
• Interfere with or disrupt the Service or its servers.
• Manipulate scores or data in Raid Mode or leaderboards.
• Use the Service to harass or harm other users.

4. Golf Data and Content

You retain ownership of your golf data (scores, rounds, statistics). By using the Service, you grant us a limited license to use anonymized, aggregated data to improve our ML models and overall service quality.

5. AI and ML Features

Club identification and training recommendations are generated by machine learning models. These features provide suggestions and may not always be accurate. You should not rely solely on AI-generated club recommendations for competitive play decisions.

6. Subscription and Payments

Certain features may require a paid subscription. Subscriptions are billed through Apple's App Store and are subject to Apple's terms. You can manage or cancel your subscription in your Apple ID settings.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to inaccurate GPS data, incorrect club suggestions, or data loss. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app's Settings. Upon termination, your data will be handled according to our Privacy Policy.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of significant changes via the app or email.

10. Governing Law

These Terms are governed by the laws of the Dominican Republic. Any disputes shall be resolved in the courts of Santo Domingo, Dominican Republic.

Estos Terminos de Servicio ("Terminos") rigen el uso de la aplicacion y el sitio web de Leveling Golf operado por Leveling Golf ("nosotros", "nuestro"). Al usar nuestro Servicio, usted acepta estos Terminos.

1. Uso del Servicio

Leveling Golf proporciona una aplicacion de caddie de golf que utiliza datos de sensores de su Apple Watch para detectar swings, identificar palos, rastrear puntuaciones y proporcionar datos GPS del campo. Debe tener al menos 13 anos para usar el Servicio.

2. Cuenta

Puede iniciar sesion utilizando Iniciar sesion con Apple. Usted es responsable de mantener la seguridad de su cuenta. Acepta proporcionar informacion precisa y mantenerla actualizada.

3. Uso Aceptable

Usted acepta no:

• Usar el Servicio para cualquier proposito ilegal.
• Intentar realizar ingenieria inversa, descompilar o desensamblar la aplicacion.
• Interferir o interrumpir el Servicio o sus servidores.
• Manipular puntuaciones o datos en el Modo Raid o tablas de clasificacion.
• Usar el Servicio para acosar o danar a otros usuarios.

4. Datos de Golf y Contenido

Usted conserva la propiedad de sus datos de golf (puntuaciones, rondas, estadisticas). Al usar el Servicio, nos otorga una licencia limitada para usar datos anonimizados y agregados para mejorar nuestros modelos de ML y la calidad general del servicio.

5. Funciones de IA y ML

La identificacion de palos y las recomendaciones de entrenamiento son generadas por modelos de machine learning. Estas funciones proporcionan sugerencias y pueden no ser siempre precisas. No debe confiar unicamente en las recomendaciones de palos generadas por IA para decisiones de juego competitivo.

6. Suscripcion y Pagos

Ciertas funciones pueden requerir una suscripcion de pago. Las suscripciones se facturan a traves del App Store de Apple y estan sujetas a los terminos de Apple. Puede administrar o cancelar su suscripcion en la configuracion de su Apple ID.

7. Limitacion de Responsabilidad

El Servicio se proporciona "tal cual" sin garantias de ningun tipo. No somos responsables de ningun dano derivado de su uso del Servicio, incluyendo pero no limitado a datos GPS inexactos, sugerencias incorrectas de palos o perdida de datos. Nuestra responsabilidad total no excedera el monto que pago por el Servicio en los 12 meses anteriores a la reclamacion.

8. Terminacion

Podemos suspender o terminar su cuenta si viola estos Terminos. Puede eliminar su cuenta en cualquier momento a traves de la Configuracion de la app. Tras la terminacion, sus datos se manejaran segun nuestra Politica de Privacidad.

9. Cambios a los Terminos

Podemos actualizar estos Terminos periodicamente. El uso continuado del Servicio despues de los cambios constituye la aceptacion de los nuevos Terminos. Le notificaremos los cambios significativos a traves de la app o correo electronico.

10. Ley Aplicable

Estos Terminos se rigen por las leyes de la Republica Dominicana. Cualquier disputa se resolvera en los tribunales de Santo Domingo, Republica Dominicana.
